Terms of Service

1. Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of the Gander platform, website, and services (collectively, the “Services”). By creating an account, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

2. Description of Services

Gander provides a platform for leasing teams to host live video tours, record calls with consent, generate AI-powered prospect recaps, and manage tour scheduling. Features and functionality may change as we improve the product.

3. Accounts and Eligibility

To use the Services, you must create an account. You agree to:

  • Provide accurate and complete information when registering.
  • Maintain the security of your account credentials.
  • Notify us immediately of any unauthorized access or security breach.
  • Be at least 18 years old and have authority to bind your organization.

4. Acceptable Use

You agree not to use the Services to:

  • Violate any applicable law, regulation, or third-party right.
  • Record calls without obtaining all required consents.
  • Upload, transmit, or distribute harmful, unlawful, or offensive content.
  • Interfere with the integrity or performance of the platform.
  • Attempt to gain unauthorized access to the Services or related systems.
  • Reverse engineer, decompile, or disassemble any part of the Services.

5. Recording Consent

You are solely responsible for complying with all applicable recording consent laws, including two-party and all-party consent requirements, in the jurisdictions where you operate. Gander provides consent prompts as a tool, but it is your responsibility to ensure lawful use.

6. Fees and Payment

Certain features of the Services require payment of fees. All fees are quoted in US dollars and billed in advance unless otherwise stated. You authorize us to charge your selected payment method. Overage fees apply to usage beyond your plan’s included amount. Fees are non-refundable except where required by law.

7. Intellectual Property

Gander and its licensors own all rights, title, and interest in the Services, including all software, designs, trademarks, and content. You retain ownership of the data you upload. By using the Services, you grant us a limited license to process your data solely to provide and improve the Services.

8. Termination

You may cancel your account at any time. We may suspend or terminate your access if you violate these Terms or if required by law. Upon termination, your right to use the Services ceases immediately. Certain provisions of these Terms will survive termination.

9. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GANDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Indemnification

You agree to indemnify and hold harmless Gander and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your violation of these Terms, or your violation of any third-party right.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.

13. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated by posting the updated Terms with a new effective date. Your continued use of the Services after changes constitutes acceptance of the revised Terms.
